Sexting among teens and tweens is a relatively new phenomenon, and many state legislatures are still trying to determine what to do about it. Because of this, laws concerning sexting vary widely. It can be easy to assume your child would never sext someone else, but kids often feel pressure to exchange sexual messages, images, or videos, so taking the time to have an open conversation with them can give them the opportunity to express any concerns. What is Sexting?

While not all state laws officially define sexting, it’s generally regarded as the act of digitally sending or sharing sexually explicit images and/or texts. These can be nude or semi-nude images or just explicit texts. Typically, sexting occurs via text message, but any electronic transfer fits the definition — emailing, sending Instagram DMs, Snapchat selfies, and even TikTok messages. Young people don’t always know that what they’re doing can, in fact, be illegal and that the ramifications for these actions lead to criminal prosecution.

The EARN IT Act (Eliminating Abusive and Rampant Neglect of Interactive Technologies Act) was passed unanimously by the Senate Judiciary Committee, 22-0, with bipartisan support in 2020 but a busy calendar prevented further action. We need you to tell your congressional members to re-introduce the EARN IT Act for 2021-22 and commit to co-sponsor it!

Child sexual abuse material (CSAM, aka child pornography) is rampant on the internet, One reason is because courts interpreted Section 230 of the Communications Decency Act (CDA) as granting interactive computer services near blanket immunity from liability. So Big Tech has no incentive to prevent CSAM and eliminate it from digital platforms. They won’t even take it down after victims complain!

A New York Times investigation last fall entitled, “The Internet is Overrun with Images of Child Sexual Abuse. What Went Wrong?” noted that in 2008, over 600,000 images/videos of CSAM were reported to NCMEC. It was called an epidemic. Yet, in 2019, 70,000,000—70 million—CSAM images were reported. The New York Times called it an “almost unfathomable” increase in criminal behavior. Internet platforms have not earned any right to immunity when they facilitate crime, especially a crime that causes deep, lifelong harm to its victims.

The EARN IT Act entails a precise, surgical, socially responsible change to CDA 230 that will directly address this horrific criminality by effectively ending impunity for online platforms that profit from child sexual exploitation. The Earn It Act will finally introduce accountability for Big Tech. Please tell your Senators and Members of Congress to re-introduce and co-sponsor today!

01-12 Sex Abuse Lawsuit Against Prince Andrew Can Go Forward: Judge

A federal judge on Wednesday ruled that the sex abuse lawsuit against Prince Andrew brought by a longtime Jeffrey Epstein accuser could move forward.

In a Wednesday morning opinion, Judge Lewis Kaplan denied the royal’s motion to dismiss Virginia Giuffre’s suit against him.

Andrew’s attorneys had argued in their motion to dismiss the suit that Giuffre was barred from suing him because of a 2009 settlement agreement that she inked with Epstein to dismiss a Florida suit she brought against the pedophile.

The agreement releases “other potential defendants” from being sued by Giuffre, but Kaplan wrote in his decision Wednesday that the language of the agreement is too ambiguous for him to dismiss the suit against Andrew.

01-10 Would You Know What To Do? Report Child Sex Trafficking to the Cyber Tipline!

Child sex trafficking is a form of child abuse that occurs when a child under 18 is advertised, solicited or exploited through a commercial sex act.  A commercial sex act is any sex act where something of value – such as money, drugs or a place to stay –  is given to or received by any person for sexual activity.  

While any child can be targeted by a trafficker, research, data and survivor lived experience and expertise have revealed traffickers and buyers often target youth who lack strong support networks, have experienced violence in the past, are experiencing homelessness, or are marginalized by society.  Traffickers are masters of manipulation and prey upon vulnerabilities using psychological pressure and intimidation to control and sexually exploit the child for their benefit.  The issue of child sex trafficking is complex.  Understanding the various forms of child sex trafficking and indicators can create opportunities for prevention, identification and response.  Most importantly NCMEC embraces and encourages all efforts on this issue to be survivor-informed, child-centered, and trauma-informed.

01-08 Trafficking Jam Innovates Curriculum As It Educates Youth About Sex Trafficking

For seven years, Mercer University students have raised awareness about sex trafficking and educated Macon-area ninth graders on its warning signs and dangers.

When the COVID-19 pandemic prevented the college students from going into high schools this spring, the Traffick Jam program’s faculty leader decided to use the time to innovate the curriculum. The changes could help other universities adopt the program and roll it out in their own communities.

“I really thought of it as an opportunity rather than a limitation after I literally got teary-eyed thinking about the prospect of not going into the schools,” said Dr. Tammy Crutchfield, associate dean and professor of marketing in the Stetson-Hatcher School of Business.

She created an innovation team consisting of graphic designers, content writers and videographers, as well as students who previously taught the program in schools. Together, they redesigned the Traffick Jam curriculum.
